In Illinois, Driving Under the Influence (DUI) is defined as operating a vehicle with a blood-alcohol content (BAC) of .08 percent or higher. However, drivers can also be charged with DUI if their BAC exceeds .05 percent, given additional evidence. DUI charges extend beyond alcohol to include impairment from any substance, whether legal or illegal, that affects a driver’s ability to operate a vehicle safely.

When driving on Illinois roadways, individuals consent to testing for alcohol or drugs. Refusing to undergo such testing results in a more severe suspension of driving privileges compared to a failed test. Additionally, refusal to test can be used as evidence in a DUI case.

Suspension refers to a temporary loss of driving privileges, and drivers must meet specific requirements and pay fees for reinstatement. In contrast, a revocation is a more permanent loss of driving privileges with no guarantee of reinstatement, though individuals can apply for reinstatement after the revocation period. Reinstatement requires retesting and fee payment for a new driver’s license.

DUI-related offenses may be categorized as violent crimes, misdemeanors, or felonies and cannot be expunged from a driving record. For those facing DUI charges, state-licensed services are available for evaluations, risk education, and treatment. These services are offered through circuit courts and the Secretary of State, and include professional, confidential, and convenient options with a sliding fee scale.
