In Illinois, individuals arrested for driving under the influence (DUI) must undergo a comprehensive alcohol and drug evaluation before sentencing or the consideration of restricted or full driving privileges by the Office of the Secretary of State. This evaluation assesses the extent of the individual’s substance use and its impact on public safety. Key elements of the evaluation include a review of the defendant’s driving history, chemical test results, Objective Test scores, and a detailed interview focusing on past and current substance use. Discrepancies between the defendant's statements and other evidence can invalidate the evaluation, leading to possible denial of driving privileges, additional evaluations at the defendant's expense, or delays in sentencing.

For DUI cases, the evaluation results in a classification—Minimal Risk, Moderate Risk, Significant Risk, or High Risk—and corresponding recommendations. Minimal Risk usually requires ten hours of DUI Risk Education. Moderate Risk involves ten hours of DUI Risk Education plus twelve hours of early intervention and any recommended treatment and ongoing participation in a continuing care plan. Significant Risk demands ten hours of DUI Risk Education, twenty hours of substance abuse treatment, and active participation in a continuing care plan. High Risk necessitates seventy-five hours of substance abuse treatment along with continuing care participation.

Ultimately, the Court decides the specific sanctions for a DUI offense, while the Office of the Secretary of State requires compliance with the evaluation recommendations for the restoration of driving privileges. Defendants have the right to contest the evaluation, withdraw, or seek a second opinion, but must be aware that the evaluation information may be shared with relevant authorities if requested.
