Drug and Alcohol Deferral Service Program (DADS)
The Drug and Alcohol Deferral Service (DADS) program offers first-time DUI offenders an opportunity to have their charges dismissed upon successfully completing program requirements. Participation in DADS is a voluntary agreement between the defendant and the prosecutor, designed to promote accountability, education, and rehabilitation.
To qualify for DADS, individuals must meet specific criteria, including no prior DUI convictions, no previous participation in a DUI deferral program, and no additional charges such as battery on a police officer or leaving the scene of an accident associated with the DUI. Additionally, participants cannot be on probation, parole, or community supervision, nor possess a Commercial Driver’s License (CDL).
Program requirements include a comprehensive substance abuse assessment conducted by certified staff. Based on this assessment, participants must complete an appropriate level of services, which may include a minimum of 20 hours of alcohol and drug education classes, outpatient counseling or treatment, or inpatient treatment services. All participants are subject to random drug and alcohol screenings and are required to meet regularly with a program case manager throughout the year to ensure compliance and monitor progress.
The DADS program provides a second chance for eligible individuals to address substance use issues, fulfill legal obligations, and work toward a positive resolution of their case. Through structured education and treatment, DADS promotes long-term behavioral changes while giving participants the opportunity to avoid a DUI conviction.
