The South Carolina Alcohol and Drug Safety Action Program (ADSAP) is designed for individuals convicted of DUI, BUI, or related offenses, including those with high BAC levels or refusals to take sobriety tests. The program aims to reduce future alcohol or drug-related incidents and enhance road safety in South Carolina. Offenders must enroll in ADSAP within 30 days of their conviction to avoid contempt of court. The program duration varies, typically ranging from 8 weeks to a year, depending on the individual’s progress and assessment. Costs for the program range from $500 to $2500, based on the client’s specific needs.

Upon enrollment, the ADSAP provider notifies the court, and the completion status is reported back to ensure compliance. To reinstate a suspended driver’s license, individuals must complete the ADSAP program, as the DMV requires proof of successful completion. ADSAP services are available through the state’s 46 county agencies and are certified by the South Carolina Department of Alcohol and Other Drug Abuse Services (DAODAS).

Clients may qualify for a provisional license if they are first-time offenders and meet specific conditions, including enrollment in ADSAP and payment of required fees. The DMV processes enrollment notifications electronically, typically within 5 to 10 business days. Post-program, individuals need to address any additional DMV requirements, such as reinstatement fees and insurance. Failure to adhere to program requirements, including repeated drug test failures or absences, can lead to program termination or additional treatment. The recent Emma’s Law mandates ignition interlock devices for certain offenders to enhance compliance and safety.
