The Impaired Driver Program (IDP), formerly known as the Drinking Driver Program (DDP), is a crucial component for those convicted of alcohol or drug-related driving violations in New York State. If you are convicted, your license or driving privileges will be revoked or suspended. However, participation in the IDP, or an approved out-of-state program, may make you eligible for a conditional license or driving privilege.

Upon conviction, you will receive an "Order of Suspension or Revocation" from the Department of Motor Vehicles (DMV), indicating a nearby motor vehicle office where you can enroll in the IDP and apply for a conditional license if eligible. Your suspension or revocation begins on the effective date of this order, typically starting at your hearing or sentencing unless the court grants a "Continuation of Driving Privileges" (MV-1192). Driving while your license is suspended or revoked is a criminal offense, punishable by fines, jail time, probation, and possible impoundment of your vehicle.

If placed on probation due to your conviction, you must obtain written permission from the sentencing court or your probation officer to apply for a license. Additionally, if convicted of Driving While Intoxicated (DWI), Driving While Ability Impaired (DWAI), or similar offenses, you will be required to pay a driver responsibility assessment annually for three years.

Participation in the IDP does not affect fines, fees, or penalties under the driver responsibility assessment program. It is essential to comply with all legal requirements and penalties following a conviction.
