New York Impaired Driver Program

The IDP educates about high-risk substance use, aiming to change behaviors. It uses presentations, discussions, and workbooks, including a preliminary substance abuse risk screening. Those at risk are referred for further assessment and treatment. IDP participation is usually voluntary (unless the individual has participated or been convicted of a similar violation within 5 years), but courts can mandate it. There is a $75 enrollment fee and up to a $233 program fee.

The IDP involves seven 2-3 hour weekly sessions. Formal substance abuse assessment referrals can come from the court, probation, or the IDP itself. Unsatisfactory assessment/treatment completion results in being dropped from the program. Treatment ordered before IDP enrollment must be completed first. A "Notice of Completion" is issued after fulfilling all requirements. License restoration depends on the driving record.

Being dropped from the IDP (for non-attendance, etc.) results in license revocation. Re-entry requires director consent and a $50 fee. Those dropped for over 90 days must restart the program. Courts may issue conditional discharges requiring IDP completion; the DMV notifies the court of non-enrollment or being dropped from the program.
