In North Carolina, if you are convicted of Driving While Impaired (DWI), you must complete a substance use assessment and an education or treatment program to have your driver’s license reinstated. The North Carolina DWI process is overseen by certified providers who follow strict guidelines to determine the level of intervention you require.
All DWI assessments must be conducted in person by an authorized DWI provider, using the American Society of Addiction Medicine (ASAM) criteria to assess your needs. If you do not receive a substance use diagnosis, you will be referred to an educational program, such as the Alcohol Drug Education Traffic School (ADETS). (ADETS) is designed for individuals at risk for substance use disorders but who have not been diagnosed. The program utilizes the PRIME for Life curriculum, which aims to prevent future alcohol or drug problems.
If your blood alcohol concentration (BAC) was over 0.14% or if you refused to take a breath test, you will be referred to a treatment program, which may include group therapy sessions with certified counselors. These treatment groups must be small, with no more than 20 clients, and provide professional, ethical services based on your specific needs.
For individuals living outside of North Carolina, the state's DWI rules still apply. You must complete a substance use assessment and education or treatment program to resolve your DWI offense. Your out-of-state completion must be reviewed and approved by a certified North Carolina provider to be accepted.
